Manila runs 13 hours ahead of Toronto in winter and 12 in summer, so an Eastern shift is a night shift in the Philippines and we staff and pay for it as one. On Pacific time? Do I need to remit CPP or EI? +
No. CPP contributions and EI premiums are for people you employ in Canada. Your VA works from the Philippines and is our employee, not yours, so there is nothing to deduct, nothing to remit and no T4 to file.
Is there a CRA misclassification risk? +
The CRA’s employee or self-employed test is about people you engage directly. You’re engaging us, a company, and we employ your VA in the Philippines. You pay one invoice, like any other vendor.
Can my VA handle customer data under PIPEDA? +
Yes. PIPEDA doesn’t stop you using a service provider outside Canada, but you stay accountable for the data. The Privacy Commissioner’s guidance is to protect it by contract and tell customers it may be processed outside Canada.
